Terms of Service

1. Acceptance of Terms

By accessing and using Boostack ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Boostack provides a platform that allows users to create forms, collect feedback, and manage customer insights. We reserve the right to modify or discontinue the Service (or any part thereof) at any time.

3. Payments & Subscriptions

We use Dodo Payments as our authorized reseller and Merchant of Record. By purchasing a subscription, you agree to Dodo Payments' Terms of Service in addition to ours.

• Billing Cycle: Subscriptions are billed in advance on a recurring basis (monthly or yearly). You may choose your preferred billing cycle during checkout or switch between cycles in your billing settings.
• Cancellation: You may cancel your subscription at any time. Your access will continue until the end of the current billing period (the end of the month or year, depending on your cycle).
• Refunds: As a general policy, we do not offer refunds for partial billing periods, but exceptions may be made for technical issues preventing service use.

4. Usage Limits & Account Enforcement

The Service is subject to usage limits based on your subscription plan. For free plan users, the limit is 5 testimonials per account.

• Account-Wide Limits: Limits are enforced across your entire account (all projects combined), not per individual project.
• Pending Testimonials: All testimonials (including those in pending status) count towards your total limit.
• Email Notifications: We will notify you via email when you approach or reach your usage limits. You are responsible for ensuring your account email is correct.

5. Content and Conduct

You retain ownership of any content you submit to the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content in connection with the Service.

You agree not to use the Service to:

• Upload or transmit content that is unlawful, harmful, or violates any third-party rights.
• Impersonate any person or entity.
• Interfere with or disrupt the Service or servers/networks connected to the Service.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Boostack and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Limitation of Liability

In no event shall Boostack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

10. Affiliate Program

Participation in our Affiliate Program is subject to the following additional terms:

• Self-Referrals: You are not permitted to use your own referral link to sign up for a paid plan. Any such actions will result in immediate disqualification and forfeiture of commissions.
• Payouts: Commissions are paid out manually on a monthly basis, provided you meet the minimum threshold of $100. We support PayPal and Amazon Gift Cards as payout methods. We reserve the right to delay or withhold payouts for suspicious activity.
• Marketing Policy: You must not use spam, deceptive marketing practices, or bid on our brand keywords in search engine marketing.
• Termination: We reserve the right to terminate any affiliate account at our discretion for violations of these terms.
• Updates: We reserve the right to change the Terms of Service for our affiliate program at any time. Your continued participation in the program after such changes constitutes your acceptance of the new terms.
